I'm thinking of disposing of my Toshiba laptop running Vista and so to clear the Hard Drive would do a factory restore (there is a recovery partition plus I have the original Toshiba restore CD)
I'm prepared to download the service packs and updates but my question is - I know I updated the BIOS 2 or 3 times from Toshiba recommended updates, will the BIOS revert to the original version and need updating again or does the BIOS remain unaffected by a factory restore?

I don't think so - a factory restore will affect the hard disk, not the BIOS chip.

After a factory system recover, one needs to look for the "Windows.OLD" file/folder. It contains a copy of the old OS and files. One needs to delete this so no data can be restored.

the factory restores I've seen wipe out the HD and restore to condition it was when it left the factory. No data, no nothing left from before the restore.

If you have the original Toshiba restore CD then I'd got for the nuclear option and use DBAN to wipe the drive completely and then restore from the master disc.
